Terms of Service

1. Acceptance
These Terms govern your use of Flock, a mobile application operated by Javier Vendrell-Moller, based in Spain ("Flock", "we", "us"). By installing, signing up, or using the app, you agree to these Terms. If you do not agree, do not use Flock.
2. The Service
Flock is a real-time location-sharing app designed for festivals and group events. It lets you share your live location with members of your flock (group) and communicate via chat, flares, rally points, and SOS alerts.
3. Eligibility & Your Account
- You must be at least 16 years old to use Flock.
- You must provide accurate information when creating an account.
- You are responsible for keeping your login credentials secure and for all activity under your account.
- One person per account — do not share accounts.
4. Acceptable Use
You agree not to:
- Use Flock to stalk, harass, surveil, or track anyone without their clear consent.
- Send abusive, threatening, hateful, defamatory, sexually explicit, or illegal content through chat, flares, or any other feature.
- Misuse the SOS feature for non-emergency situations.
- Attempt to access other users' data, reverse-engineer the app, or interfere with the service.
- Use Flock for any commercial purpose without written permission.
- Bypass or disable security or access-control features.
- Upload malware, spam, or content that infringes on another's rights.
5. User Content & Moderation
You own the content you create (messages, photos, flares). By posting content in a flock, you grant Flock a non-exclusive, royalty-free license to transmit and display that content to your flock members as part of delivering the service.
Flock has zero tolerance for objectionable content or abusive behavior. You can report content or users by long-pressing any message or by emailing abuse@flock-app.app. We review reports within 24 hours and may remove content, suspend, or permanently ban users who violate these Terms.
6. Location Sharing
Location sharing is opt-in. You control when your location is shared and with whom. By joining a flock, you consent to sharing your location with the other members of that flock while the feature is active. You can leave a flock or stop sharing at any time.
7. Intellectual Property
The Flock app, including its name, logo, code, design, and content created by us, is our property and protected by intellectual property laws. These Terms do not grant you any ownership rights in Flock itself, only a limited license to use the app.
8. Third-Party Services
Flock relies on third-party services (Firebase, Railway, Apple Push Notification Service, Google Firebase Cloud Messaging, Sentry). Your use of Flock is also subject to those providers' terms where applicable. We are not responsible for outages or issues caused by third-party services.
9. Availability & "As Is"
Flock is provided "as is" and "as available", without warranties of any kind, express or implied. We do our best to keep the service running, but we do not guarantee uninterrupted availability, error-free operation, or accuracy of location data. Location accuracy depends on your device, signal environment, and network conditions.
10. Not a Safety Device
Flock is a tool to help you find friends at events. It is not a safety device, not a medical device, and not a replacement for emergency services. In an emergency, always contact local emergency services (112 in the EU, 911 in the US).
11. Limitation of Liability
To the maximum extent permitted by law, Flock and its operator are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the service. Our total liability in any matter is limited to €50 or the amount you paid us in the prior 12 months, whichever is greater.
12. Indemnification
You agree to indemnify and hold Flock harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your content, your violation of these Terms, or your violation of another person's rights.
13. Termination
You may delete your account at any time from the app's Settings screen or by emailing hello@flock-app.app. We may suspend or terminate accounts that violate these Terms, with or without notice.
14. Governing Law & Disputes
These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. Disputes will be resolved in the courts of Barcelona, Spain, unless mandatory local law (including consumer protection laws in your country of residence) requires otherwise.
15. Changes
We may update these Terms from time to time. Material changes will be announced in the app. Continued use after a change means you accept the new Terms. The "Last updated" date above always reflects the current version.
16. Apple App Store Additional Terms
If you obtained Flock from the Apple App Store:
- These Terms are between you and Flock — not Apple. Apple is not responsible for Flock or its content.
- Your use of Flock must also comply with the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for Flock.
- In the event Flock fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.
- Flock, not Apple, is responsible for addressing product liability claims, consumer protection claims, and intellectual property infringement claims related to the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as a user.
17. Severability & Entire Agreement
If any provision of these Terms is found unenforceable, the rest remain in full effect. These Terms, together with the Privacy Policy, form the entire agreement between you and Flock regarding the app.
